  • Harass, threaten, or abuse other players

6. Virtual Goods and Purchases

Our games may include:

  • In-game currency

  • Cosmetic items

  • Downloadable content (DLC)

  • Other virtual goods

Virtual goods:

  • Have no real-world monetary value

  • Cannot be transferred outside the game

  • Are licensed, not sold

All purchases are final except where refunds are required by law or handled through the platform provider from which the purchase was made (for example Steam, the Microsoft Store, PlayStation Store, or Nintendo eShop).

 

7. Third-Party Platforms

Our games may be distributed through third-party platforms including but not limited to:

  • Steam​

  • Microsoft Store / Xbox

  • Nintendo eShop

Your use of these platforms is also governed by the terms and policies of those providers.

Burst2Flame Games  is not responsible for the policies, services, or actions of third-party platforms.

You may create or share content such as:

  • Screenshots​

  • Gameplay videos or streams

  • Feedback​

  • Forum posts or Discord messages

By submitting content to our Services, you grant Burst2Flame Games a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content in connection with the promotion and operation of the Services.

You agree that your content will not:

  • Infringe on intellectual property rights

  • Contain illegal, abusive, or harmful material

  • Violate privacy or publicity rights

We reserve the right to remove content that violates these Terms.

 

9. Content Creation and Streaming

We welcome content creators, streamers, and video producers who wish to create content featuring our games.

You may create and share gameplay videos, livestreams, reviews, and other content using our games, including monetized content, provided that:

  • You do not claim ownership of our intellectual property

  • You do not distribute the games themselves

  • You do not promote cheats, hacks, or exploits

  • You do not misrepresent our games or brand

We reserve the right to request removal of content that violates these Terms.

 

10. Intellectual Property

All games, software, artwork, designs, music, characters, trademarks, and other materials within the Services are the property of Burst2Flame Games or its licensors.

You may not:

  • Copy, distribute, or reproduce our content

  • Create derivative works based on our assets

  • Sell or redistribute our content

  • Extract or reverse engineer game assets or code

except where explicitly permitted by law or by us.

 

11. Updates and Changes to Services

We may update, modify, or improve the Services at any time.

This may include:

  • Patches or bug fixes

  • Balance adjustments

  • Feature additions or removals

  • Server maintenance

We do not guarantee that any specific feature will remain available indefinitely.

 

12. Service Availability

We do not guarantee that the Services will always be:

  • ​error-free

  • ​secure

  • compatible with all devices or systems

We may suspend or discontinue parts of the Services at any time.

 

13. Loss of Data or Game Progress

While we make reasonable efforts to maintain reliable services, we cannot guarantee that player data, saved progress, or virtual items will always be preserved.

Burst2Flame Games is not responsible for the loss of game progress, saved data, or virtual items caused by technical issues, updates, or service disruptions.

 

14. Suspension and Termination

We may suspend or terminate access to the Services if you:

  • Violate these Terms

  • Disrupt the community

  • Engage in cheating or exploitation

  • Attempt to interfere with the Services

Termination may result in the loss of access to your account, game progress, or virtual items.

 

15. Community Moderation and Discord Servers

Burst2Flame Games operates official Discord servers to support our community. Moderators on these servers are volunteers from the community and are not employees or agents of Burst2Flame Games.

While we carefully select trusted members of the community to serve as moderators and strive to ensure they act fairly and impartially, Burst2Flame Games does not accept any liability for their actions, errors, or omissions. Mistakes may occur, and we cannot be held responsible if moderators fail to meet community expectations or enforce rules perfectly.

By participating in our Discord servers, you agree to abide by the moderators’ decisions and rules, but you acknowledge that Burst2Flame Games is not responsible for any disputes or issues arising from moderation.

 

16. Disclaimers

The Services are provided "as is" and "as available."

To the fullest extent permitted by law, Burst2Flame Games makes no warranties, express or implied, regarding the reliability, availability, or performance of the Services.

 

17. Limitation of Liability

To the maximum extent permitted by law, Burst2Flame Games shall not be liable for indirect, incidental, special, or consequential damages, including loss of data, loss of progress, or loss of virtual items.

 

18. Force Majeure

We are not responsible for delays or failure to perform resulting from events outside our reasonable control, including but not limited to:

  • natural disasters

  • internet outages

  • power failures

  • cyber attacks​

  • actions of third-party service providers

 

19. Changes to These Terms

We may update these Terms from time to time.

When we do, we will update the "Last Updated" date at the top of this document.

Continued use of the Services after changes means you accept the updated Terms.

 

20. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles.

Any disputes arising from these Terms shall be resolved in the state or federal courts located in California, United States. Any disputes shall be resolved exclusively in the courts located in Madera County, California.

Nothing in these Terms limits any consumer rights that cannot be waived under applicable law.
